Terms & Conditions
These Terms & Conditions apply to all purchases (online and in person), workshop bookings, Sip & Paint events, commissioned artwork, and the use of the Flip Moller Art website.
By placing an order, booking a service, or submitting a commission request, the customer agrees to these Terms & Conditions. Where applicable, the Refund & Cancellation Policy forms an integral part of these Terms.

2. Definitions
For the purpose of these Terms & Conditions:
- Artwork: Original physical paintings created by Flip Moller Art
- Commissioned Artwork: Custom-made artwork created upon customer request
- Workshop Package: A bundled experience consisting of multiple scheduled sessions
- Sip & Paint Event: A guided group painting event held at a scheduled time
- Customer: Any individual purchasing products or services from Flip Moller Art
- Website: www.flipmollerart.com (and all language versions)
3. Products and Artwork
All artworks displayed on this website are original works created by Flip Moller unless explicitly stated otherwise.
Due to the handmade nature of artworks, minor variations in colour, texture, and appearance may occur between digital representation and the physical piece.
Availability of artworks is not guaranteed and may change without prior notice.
4. Orders and Payments
Orders are confirmed only after successful payment has been received.
Payments are processed securely through approved third-party payment providers.
Flip Moller Art reserves the right to refuse or cancel orders in cases of suspected fraud, pricing errors, or technical issues.
For commissioned artworks:
- A 50% non-refundable deposit is required upon confirmation
- The remaining 50% is due upon completion, before delivery or collection
5. Shipping and Collection
Physical artworks may be:
- Shipped via third-party courier services
- Collected in person by appointment
Shipping costs are calculated separately during checkout unless stated otherwise.
Customers are responsible for providing accurate shipping information.
5.1 Shipping responsibility, insurance and claims
Risk transfers to the customer upon confirmed delivery by the courier.
Shipping insurance may be offered or discussed prior to shipment depending on the destination, value, and shipping method. Where applicable, insurance coverage is optional and may affect the level of compensation in the event of damage or loss.
If an artwork arrives damaged or is lost:
- The customer must report the issue within 48 hours of delivery
- Clear photographic evidence is required
- The artwork must remain in its received condition for assessment
Claims will be handled in cooperation with the shipping provider and any applicable insurance coverage.
Resolution depends on the outcome of the carrier investigation and insurance terms and may include repair, replacement (if possible), or compensation in accordance with the applicable coverage.
6. Workshops and Events
Workshop and Sip & Paint bookings are subject to availability and may require a minimum number of participants.
If Flip Moller Art cancels or reschedules an event, customers will be offered a refund or alternative date.
All cancellations and refund conditions are governed by the Refund & Cancellation Policy.
Customers are responsible for attending scheduled sessions. Missed sessions are not refundable. Participants who miss a scheduled workshop session may attend a catch-up session on any Friday between 12:00 pm and 5:00 pm, subject to workshop availability. Catch-up sessions operate on a walk-in basis and do not require prior booking or notice.
Participants are expected to behave respectfully and safely during workshops and events.
Flip Moller Art reserves the right to refuse participation or remove individuals in cases of unsafe, disruptive, aggressive, or inappropriate behaviour without refund.
7. Commissioned Artwork
Commissioned artworks are custom-made pieces created specifically for the customer based on agreed reference material and instructions.
Commissioned artworks typically require a production time of approximately 2 to 8 weeks, depending on complexity and current workload.
A commission proceeds only after mutual agreement and confirmation.
Commission conditions:
- 50% non-refundable deposit required before work begins
- Remaining 50% due upon completion, before delivery or collection
- Each artwork is created as an original artistic interpretation and does not include revision rounds
The deposit covers:
- Consultation and planning
- Material preparation
- Allocation of studio time
Due to the handmade nature of the work, final artworks may differ slightly from reference images.
If a commissioned artwork is not accepted by the client upon completion, or if the remaining 50% balance is not paid, the initial 50% deposit remains non-refundable. In such cases, the artwork remains the property of Flip Moller Art.
Non-portrait commissioned works that are not accepted or not completed due to non-payment may be made available for sale at the discretion of Flip Moller Art.
Flip Moller Art reserves the right to refuse commission requests at its discretion.
8. Intellectual Property
All artwork, images, text, designs, and content displayed on this website remain the intellectual property of Flip Moller Art unless stated otherwise.
Artwork and website content may not be:
- Copied
- Reproduced
- Distributed
- Printed
- Downloaded for commercial purposes
- Modified
- Used commercially
- Used for AI training, machine learning datasets, or generative artificial intelligence systems
without prior written permission from Flip Moller Art.
Purchasing artwork does not transfer copyright or reproduction rights to the buyer.
9. Website Content
While every effort is made to ensure accurate information, Flip Moller Art does not guarantee that all website content is free from errors, inaccuracies, or omissions.
Content, pricing, and availability may be updated or changed at any time without prior notice.
10. Right of Withdrawal (EU Consumer Law)
Where applicable under EU law, consumers may have a statutory right of withdrawal of 14 days.
However, this right does not apply to:
- Custom-made commissioned artworks
- Date-specific services such as workshops and Sip & Paint events after booking confirmation
Where applicable, withdrawal rights are exercised in accordance with EU consumer protection legislation.
11. Liability
Flip Moller Art is not liable for indirect, incidental, or consequential damages arising from:
- Use of the website
- Purchase of products
- Participation in workshops or events
- Shipping or third-party delivery services
Customers may be held responsible for intentional or negligent damage caused to artworks, materials, equipment, or gallery property.
Visitors attend gallery visits, workshops, and events at their own responsibility.
Flip Moller Art is not liable for personal injury, loss, or damage to personal belongings except where liability cannot legally be excluded.
Nothing in these Terms excludes liability where prohibited under applicable consumer protection law.
12. Privacy
Personal data is processed in accordance with the Privacy Policy published on this website.
13. Governing Law
These Terms & Conditions are governed by the laws of the Netherlands.
Any disputes arising in connection with these Terms & Conditions shall fall under the jurisdiction of the competent courts of the Netherlands.
